1. Account Terms

By creating an account on AI Consensus, you agree to the following terms:

1.1 Eligibility

• You must be at least 18 years of age, or have obtained parental or guardian consent to use this service
• You must provide accurate and complete registration information
• Only one account per person or legal entity is permitted

1.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• Sharing accounts across multiple users is prohibited
• You are responsible for all activities that occur under your account

1.3 Account Termination

• We reserve the right to suspend or terminate accounts that violate these terms
• You may request account deletion at any time through your account settings or by contacting us
• Upon termination, your data will be handled according to our Data Retention policy
• You may appeal account suspension decisions by contacting support@theaiconsensus.com

2. Acceptable Use Policy

You agree not to use AI Consensus for any of the following prohibited activities:

2.1 Prohibited Content & Activities

• Engaging in any illegal activities or content generation
• Generating harmful, abusive, harassing, or discriminatory content
• Attempting to reverse engineer, scrape, or extract data from the platform
• Abusing AI models through spam, malicious queries, or attempting to generate harmful content
• Circumventing usage limits, payment systems, or access controls
• Impersonation or fraudulent activity
• Attempting to manipulate consensus results or game the system
• Uploading malicious files, code, or content

2.2 Automated Access

• Automated or bot access requires explicit written permission and an Enterprise API subscription
• Unauthorized automated access will result in immediate account termination
• Rate limits apply to all accounts regardless of subscription tier

3. Subscription & Payment Terms

3.1 Pricing & Billing

• All fees are charged in USD (EUR pricing may be displayed for EU users)
• Subscriptions are billed monthly and auto-renew unless cancelled
• Payment is processed securely through Stripe
• We reserve the right to change pricing with 30 days advance notice

3.2 Subscription Tiers

• Free: 2 AI models, 10 discussions/month, no history storage
• Professional ($29/month): 3 AI models, unlimited discussions, 90-day history
• Enterprise ($99/month): All 7 AI models, unlimited discussions, permanent history, API access

3.3 Refunds & Cancellation

• Pro-rated refunds are available within 14 days of subscription purchase
• EU Users: You have a 14-day cooling-off period for distance contracts as required by EU consumer law
• You may cancel your subscription at any time through your account settings
• Upon cancellation, paid tier features remain active until the end of your billing period
• Usage limits reset on a calendar month basis

3.4 Service Changes

• We may modify or discontinue service features with 90 days advance notice
• Material changes to paid features will be communicated via email

4. Intellectual Property

4.1 Your Content

• You retain ownership of all questions, inputs, and content you submit to the platform
• You grant us a non-exclusive license to process your data solely to provide the service
• This license terminates upon account deletion (except for anonymized aggregates)

4.2 Platform Ownership

• AI Consensus owns all rights to the consensus methodology, algorithms, and platform design
• The AI Consensus name, logo, and branding are trademarks of The AI Consensus

4.3 AI Model Outputs

• AI model outputs are subject to the respective terms of each model provider (OpenAI, Anthropic, Google, etc.)
• We make no claim to intellectual property created using the service
• We reserve the right to aggregate and anonymize data for service improvement purposes only

5. AI Model Disclaimer

5.1 No Professional Advice

• AI-generated consensus outputs are for informational purposes only
• You are solely responsible for decisions made based on consensus outputs
• Always consult qualified professionals for legal, financial, medical, or other specialized matters

5.2 No Guarantees

• We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI outputs
• AI models may produce biased, incorrect, or inappropriate content
• We act as an intermediary; AI model providers have separate terms and conditions

5.3 Service Availability

• No warranty is provided for uptime, availability, or uninterrupted service
• We are not liable for third-party AI model failures, downtime, or outputs

6. Limitation of Liability

6.1 Service Provided "As Is"

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 Limitation of Damages

• We shall not be liable for any consequential, indirect, incidental, special, or punitive damages
• Maximum liability is capped at the subscription fees you have paid in the prior 12 months
• We are not liable for third-party AI model failures, downtime, or outputs

6.3 Indemnification

You agree to indemnify and hold harmless AI Consensus, its affiliates, officers, and employees against any claims arising from your use of the service.

6.4 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, or service provider outages.

7. Data Retention & Deletion

7.1 Retention by Tier

• Free Tier: No discussion history retained after session ends
• Professional Tier: 90-day automatic deletion of discussion history
• Enterprise Tier: Permanent storage unless you request deletion

7.2 Your Rights

• Right to request data export in machine-readable format (JSON/CSV)
• Right to request deletion per GDPR Article 17 and CCPA
• 30-day grace period after subscription cancellation before data deletion

7.3 Backup Retention

• Encrypted backups are retained for 90 days, then permanently deleted
• Anonymized aggregate data may be retained indefinitely for service improvement

8. Dispute Resolution

8.1 Governing Law

These terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles.

8.2 Informal Resolution

Before initiating formal dispute resolution, you agree to attempt to resolve disputes informally by contacting legal@theaiconsensus.com.

8.3 Arbitration (US Users)

• Disputes will be resolved through binding arbitration rather than court
• You waive the right to participate in class action lawsuits
• Small claims court exception applies

9. Modifications to Terms

• We reserve the right to modify these terms with 30 days email notice
• Continued use after the notice period constitutes acceptance of modified terms
• Material changes require explicit re-acceptance on your next login
• Historical versions are available upon request

9.1 Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full effect.

9.2 Entire Agreement

These terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and AI Consensus.
